On 18 May 2018, India submitted a notification under article 12.5 of the WTO Safeguard Agreement on the decision to suspend concessions and other obligations stipulated in said agreement. The proposed suspension follows the imposition of tariffs on imports of certain steel and aluminium goods by the United States on 23 March 2018, see related state acts.
As India does not view the measures imposed by the United States for reasons of national security, India reserves the right to impose additional duties. As such, the proposed suspension will commence from 21 June 2018.
On 13 June 2018, the Indian authorities notified the WTO of a revised list of goods from the United States subject to import tariffs. Following the suspension of concessions and other obligations, India imposed import tariffs on goods from the United States listed in said notification with the exemption of certain motorcycles falling under HS code 8711.50, see related intervention.
Notably, five other countries also notified the WTO of suspending concessions and other obligations in reaction to the imposition of steel and aluminium duties by the United States, see related state acts.
