On March 7, 2018 the Laminated Woven Sacks Fair Trade Coalition filed a countervailing duty petition against imports of laminated woven sacks from Vietnam. Subject merchandise is currently classified under HTSUS 6305.33.0040 but may also be entered under HTSUS 3923.21.0080, 3923.21.0095, 3923.29.0000, 3917.39.0050, 3921.90.1100, 3921.90.1500, 4601.99.0500, 4601.99.9000, 4602.90.0000, and 5903.90.2500.
On April 20, 2018 the U.S. International Trade Commission determined that there is a reasonable indication that a U.S. industry is materially injured by reason of imports of laminated woven sacks from Vietnam that are allegedly subsidized and sold in the United States at less than fair value.
On August 7, 2018 the U.S. Department of Commerce announced the affirmative preliminary determination in the countervailing duty investigation of imports of laminated woven sacks from Vietnam, finding that exporters received countervailable subsidies ranging from 3.24 to 6.15 percent. The Department of Commerce will instruct U.S. Customs and Border Protection to collect cash deposits from importers of laminated woven sacks from Vietnam based on these preliminary rates.
