The government of Turkey on 24 March 2016 published the new framework for data protection in Turkey via the Protection of Personal Data Law.
The Law took effect on 7 April 2016.
According to this Law, all institutions operating within the Turkish jurisdiction, are for the first time obligated to ensure that personal data is not processed or transferred abroad, without the individual’s explicit consent. According to the new Law, an exception to the prior would only be allowed when the abroad transfer of data, is required by Law. This exception, however, according to the new Law would only be applicable sufficient data protection exists in the foreign country where the data is transferred or - if the local data controller provides a written security undertaking and Turkey’s Data Protection Board grants permission.
