The safeguard investigation on imports of solar cells whether or not assembled in modules or panels was initiated on 19 December 2017. The products subject to investigation are classified under HS code subheading 8541.40.11. The investigation follows the application lodged by the domestic industry.
On 30 July 2018, the Indian authorities imposed a definitive safeguard duty on imports of the subject good. The rate of duty between 30 July 2018 and 29 July 2019 is ad valorem 25%. The rate of duty between 30 July 2019 and 29 January 2020 is ad valorem 20%. The rate of duty between 30 January 2020 and 29 July 2020 is ad valorem 15%. The applied safeguard duty is minus any antidumping duty paid on the subject good, see related state act for further details. Certain developing countries are exempt from safeguard duty. The duty is in force until 30 July 2020.
