Anti-circumvention

On September 8th, 2011, the Government of Argentina determined that the importation of certain footwear from China are circumventing anti-dumping duties by being declared as originated in Malaysia. Because of the above, the Argentinean authorities resolved to apply an anti-dumping duty of 13.38 US dollars per pair to the importation of this kind of footwear from Malaysia.
In accordance with Argentinean legislation, in case of doubt on the validity of the certificates, or the veracity of the information contained in the certificates of origin that are required by Argentina, the Ministry of Industry and Commerce, can initiate a process of verification of non-preferential origin for those goods whose imports are subject to the implementation of trade policy measures such as anti-dumping duties, countervailing duties, specific duties, or safeguard measures.
The products circumventing the anti-dumping duties are classified under the following tariff code of the MERCOSUR Harmonized System: 6404.19.00 and 6404.99.90.
