Anti-circumvention

On 25 February 2017, the Turkish authorities initiated an anti-circumvention investigation on imports of polyester partially oriented yarn from China, Indonesia and Malaysia (Notification 2017/05). This investigation follows suspicion that the definitive antidumping duty, last imposed by Notification 2014/41, on imports of polyester textured yarn from China, Indonesia and Malaysia (see related intervention) might be circumvented. Additionally, the investigation follows suspicion that the definitive antidumping duty imposed on imports of polyester textured yarn from Chinese Taipei and India as well as from Thailand and Viet Nam might also be circumvented, see related measures. The products subject to investigation are classified under the following HS code subheading: 5402.46. The products concerned by the possible circumvention are classified under the following HS code subheading: 5402.33.

On 4 August 2017, the Turkish authorities imposed a provisional duty on imports of the subject good from China, Indonesia and Malaysia (Notification 2017/20). The rate of duty on imports from China is USD 263 per tonne. The rate of duty on imports from Indonesia is USD 120 per tonne. The rate of duty on imports from Malaysia is USD 138 per tonne.

On 21 June 2018, the Turkish authorities extended the antidumping duty imposed on imports of polyester partially oriented yarn from China, Indonesia and Malaysia (see related intervention) to imports of the same products falling under HS code subheading 5402.46. The rate of the duty on imports from Malaysia is 8%. The rate of the duty on imports from China is 8%. The rate of the duty on imports from Indonesia is between 2.45% and 8% depending on the company. The definitive duty is imposed on the date the provisional duty was imposed i.e. 4 August 2017. The difference between the provisional and definitive duty is refunded given the definitive duty is lower than the provisional duty.
