Anti-circumvention

On February 8, 2011, the company Indústria e Comércio Jolitex Ltda. requested investigation to ascertain the existence of circumventing practices that would challenge the definitive anti-dumping duty imposed on April 28, 2010 (Resolução No. 23, 28.04.2010) on imports of synthetic fibre blankets from China. The petitioner identified three possible circumventing practices: (1) imports of fabrics in long pile roller from China; (2) imports of synthetic fibre blankets from Chile, Paraguay and Uruguay; (3) imports of blankets like "microfiber" from China.
On May 13, 2011, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of synthetic fibre blankets from Paraguay and Uruguay as well as on imports of fabrics of synthetic fibres in long pile roller from China (Circular No. 20, 13.05.2011).
The products subject to investigation are classified under the following HS codes: 6301.4000 and 6001.1020.
The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on May 16, 2011.
On February 13, 2012, the Brazilian authorities decided to extend the definitive anti-dumping duty imposed on April 28, 2010 (Resolução No. 23, 28.04.2010) by further imposing a definitive anti-dumping duty on imports of synthetic fibre blankets from Paraguay and Uruguay as well as on imports of fabrics of synthetic fibres in long pile roller from China (Resolução No. 12, 13.02.2012).
The amount of this definitive duty in USD per kilogram is 5.22 for all Paraguayan and Uruguayan exporters of synthetic fibre blankets. The rate of the duty imposed on Chinese exports of fabrics of synthetic fibres in long pile roller is 96.6% for all Chinese exporters. This definitive anti-dumping duty entered into force on February 14, 2012 and will expire jointly with the duty imposed by Resolution No. 23 on April 28, 2010, i.e. on April 29, 2015.

On April 27th, 2015, the Brazilian authorities decided to initiate a sunset review of the anti-dumping measure imposed by Resolution No. 23 dated April 28th, 2010 on imports of synthetic fibre blankets originating in China (Circular No. 28, 27.04.2015). It follows a request lodged on December 29th, 2014 by Indústria e Comércio Jolitex Ltda. This sunset review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on April 28th, 2015. The existing anti-dumping measure remains in force during the review. Since the anti-dumping measure imposed on imports of the subject good from China was extended to imports from China, Paraguay and Uruguay, the sunset review and its conclusion will hold for these countries and products as well.

On 19 February 2016, the Brazilian authorities extended the imposition of definitive anti-dumping duty on imports of the subject good from China, Paraguay and Uruguay for a five-year period (Resolution No. 12 of 18 February 2016). The rate of duty on imports from Paraguay is USD 5.22 per kg. The rate of duty on imports from Uruguay is USD 5.22 per kg. The rate of duty on imports from China is 96.6%.
