On June 12th, 2015, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-circumvention investigation on imports of heavy plates with addition of chrome from China (Circular No. 38, 12.06.2015).
This investigation follows suspicion that the definitive anti-dumping duty imposed by Resolution No. 77 dated October 2nd, 2013 on imports of heavy plates from China might be circumvented (see related intervention).
The products subject to investigation are classified under the following HS code: 7225.4090.
The complaint was lodged on May 18th, 2015 by Usinas Siderúrgicas de Minas Gerais S.A. - USIMINAS. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on June 15th, 2015.
On August 28th, 2015, the Brazilian authorities decided to extend to imports of heavy plates with addition of chrome originating in China the definitive anti-dumping duty imposed by Resolution No. 77 dated October 2nd, 2013 on imports of heavy plates from China (Resolution No. 82, 28.08.2015). The amount of the duty is USD 211.56 per metric ton.
This measure entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on August 31st, 2015, and is applicable as long as the original duty imposed by the above-mentioned Resolution No. 77 remains in force.
