Anti-circumvention

On June 12th, 2015, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-circumvention investigation on imports of heavy plates with addition of chrome from China (Circular No. 38, 12.06.2015).
This investigation follows suspicion that the definitive anti-dumping duty imposed by Resolution No. 77 dated October 2nd, 2013 on imports of heavy plates from China might be circumvented (see related intervention).
The products subject to investigation are classified under the following HS code: 7225.4090.
The complaint was lodged on May 18th, 2015 by Usinas Siderúrgicas de Minas Gerais S.A. - USIMINAS. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on June 15th, 2015.

On August 28th, 2015, the Brazilian authorities decided to extend to imports of heavy plates with addition of chrome originating in China the definitive anti-dumping duty imposed by Resolution No. 77 dated October 2nd, 2013 on imports of heavy plates from China (Resolution No. 82, 28.08.2015). The amount of the duty is USD 211.56 per metric ton.
This measure entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on August 31st, 2015, and is applicable as long as the original duty imposed by the above-mentioned Resolution No. 77 remains in force.

On 2 October 2018, the Brazilian authorities initiated a sunset review of the definitive antidumping duty imposed on imports of heavy plates from China, South Africa, the Republic of Korea and Ukraine, see related intervention. This follows the application lodged on 30 April 2018 by Usinas Sederúrgicas de Minas Gerais S.A. - USIMINAS. Since the antidumping duty imposed on imports of heavy plates from China, South Africa, the Republic of Korea and Ukraine was extended to imports of the subject good falling under HS code 7225.40 from China, the sunset review and its conclusion will hold for these goods as well.

On 2 October 2019, the Brazilian authorities extended the definitive duty imposed on imports of the subject good from China, South Africa, the Republic of Korea and Ukraine following the conclusion of a sunset review, see related intervention. Since the antidumping duty imposed on imports of heavy plates from China, South Africa, the Republic of Korea and Ukraine was extended to imports of the subject good falling under HS code 7225.40 from China and Ukraine, the sunset review's conclusion will hold for these goods as well. The rate of duty on imports from China is USD 211.56 per tonne.
