Anti-circumvention

On March 18, 2014, Usinas Siderúrgicas de Minas Gerais S.A. (USIMINAS) requested an investigation to ascertain the existence of circumventing practices that would challenge the definitive anti-dumping duty imposed on October 3, 2013 (Resolution No. 77, 02.10.2013) on imports of low carbon and alloy steel products from China and Ukraine (see realted intervention).
On April 17, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-circumvention investigation targeting imports of painted plates from China and boron-alloyed plates from China and Ukraine.
The products subject to investigation are classified under the following HS codes: 7210.7010 (painted plates from China) and 7225.4090 (boron-alloyed plates from China and Ukraine).
The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on April 22, 2014.

On October 17, 2014, the Brazilian authorities decided to extend for up to three months, from October 22, 2014, the investigation period to determine the existence of circumventing practices in exports of painted plates from China and boron-alloyed plates from China and Ukraine (Circular No. 63, 17.10.2014). Circular No. 63 was published in the Federal Official Gazette of Brazil on October 20, 2014.

On December 18, 2014, the Brazilian authorities decided to extend the anti-dumping measure imposed on imports of heavy plates from China (see realted intervention) to imports of painted heavy plates from China and imports of boron-alloyed heavy plates from China and Ukraine (Resolution No. 119, 18.12.2014).
The amount of the duty imposed on imports of painted heavy plates (HS code 7210.7010) originating in China is USD 211.56 per metric ton. The amount of the duty imposed on imports of boron-alloyed heavy plates (HS code 7225.4090) originating in China is also USD 211.56 per metric ton. The amount of the duty imposed on imports of boron-alloyed heavy plates (HS code 7225.4090) originating in Ukraine is USD 261.79 per metric ton.
This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on December 19, 2014, and is applicable as long as the original anti-dumping measure (see realted intervention) remains enforced.

On May 11th, 2015, the Brazilian authorities decided to initiate an evaluation of the scope of products subject to the above-mentioned anti-dumping measure (Circular No. 31, 11.05.2015). This review should evaluate if some specific goods classified under HS code 7210.7010 and originating in China should continue to be subject to the measure imposed by Resolution No. 119 dated December 18th, 2014.
This review follows the application lodged on February 23rd, 2015 by Panasonic do Brasil Limitada. The review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on May 12th, 2015.

On July 22nd, 2015, the Brazilian authorities concluded the review and decided to exclude the investigated products from the scope of products subject to the anti-dumping measure imposed by Resolution No. 119 dated December 18th, 2014 (Resolution No. 70, 22.07.2015). For more details about the exact definition of those products, please see Resolution No. 70.
This modification entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on July 23rd, 2015.
