In a decision published in the July 19, 2017 edition of Customs Bulletin and Decisions, U.S. Customs and Border Protection proposed to classify a gel pack vest set used to relieve back pain as a set under HTSUS 6110.30.30, and thus subject to a 32% duty, rather than classifying each component in the set separately. With components typically being subject to much lower duties – for example, the tariff on gel preparations designed to be used in human or veterinary medicine (HTS item 3006.70.00) is 5% – this ruling will result in a higher tariff overall. Comments on the proposed modification are due no later than August 18, 2017 and the final modification will be effective for goods entered or withdrawn from warehouse for consumption on or after September 18, 2017.
