|02 Jun 2017||Renewal|
ANNOUNCED AS TEMPORARYNo
In a vote on June 2, 2017, the U.S. International Trade Commission renewed the existing antidumping order on pistachios imported from Iran. The original order was imposed in 1986, with the renewed order thus exceeding the five-year “sunset” standard that generally applies to trade-remedy measures under WTO agreements (i.e., article 21.3 of the Agreement on Subsidies and Countervailing Measures and Article 11.3 of the Antidumping Agreement).
Note that the most recent renewal of this order was made in 2005. In the normal course of events, the order would also have come up for renewal in 2010. In that year, however, the Department of Commerce determined that the issue was rendered moot by the sanctions then in place; see https://www.federalregister.gov/documents/2010/12/01/2010-30237/initiation-of-five-year-sunset-review.
