Import tariff quota

On January 23, 2017, the Brazilian Foreign Trade Council, announced the publication of Resolution 1 in the Official Gazette, reducing temporarily the import duties for a certain quota on hop, organics and inorganics chemicals, synthetic yarns, pharmaceutical products, and nickel and aluminium products (HS Codes 1210.20.10, 2921.11.21, 2929.10.30, 2833.11.10, 3215.11.00, 3908.10.24, 5403.31.00, 7502.10.10 and 7606.12.90). The import tariff reductions and quotas were as follows:

  • HS Code 1210.20.10: Import tariff reduction from 7.2% to 2% from FOB value for a twelve-month period starting on January 23, 2017, for a quota of 1,800 tonnes.
  • HS Code 2921.11.21: Import tariff reduction from 12% to 2% from FOB value for a twelve-month period starting on January 23, 2017, for a quota of 12,000 tonnes.
  • HS Code 2929.10.30: Import tariff reduction from 14% to 2% from FOB value for a twelve-month period starting on January 23, 2017, for a quota of 1,000 tonnes.
  • HS Code 2833.11.10: Import tariff reduction from 10% to 2% from FOB value for a twelve-month period starting on January 23, 2017, for a quota of 910,000 tonnes.
  • HS Codes 3215.11.00 and 3908.10.24: Import tariff reduction from 14% to 2% from FOB value for a twelve-month period starting on January 23, 2017, for a quota of 396 tonnes and 5,400 tonnes respectively.
  • HS Code 7502.10.10: Import tariff reduction from 6% to 2% from FOB value for a six-month period starting on January 23, 2017, for a quota of 3,600 tonnes.
  • HS Code 7606.12.90: Import tariff reduction from 12% to 2% from FOB value for a six-month period starting on January 23, 2017, for a quota of 600 tonnes for the case of aluminium with less than 0,30% silicon on its weight.

In addition, the tariff-rate quota on aluminium sheets and plates of thickness greater than 0.2 mm (HS Code 7606.12.90) was extended for twelve months starting on February 1, 2017, remaining both the tariff rate at 2% and the quota at 2,937 tonnes. Likewise, in the case of aluminium alloys (HS Code 7607.11.90), the 2% import tariff and the 2,137 tonnes was extended for twelve months starting on February 1, 2017. Furthermore, the tariff-rate quota on viscose rayon (HS Code 5403.31.00) was extended for another 180 days starting on February 22, 2017, and the quota was increased from 624 to 625 tonnes remaining a 2% FOB value. Moreover, with regard to vaccines against Papillomavirus (HS Code 3002.20.27) and against Hepatitis A, the tariff-rate quota was also extended for six months starting on February 22, 2017, for the former, and May 10, 2017, for the latter. In both cases, the tariff rate remained at 0% and the quota at 3,000,000 doses and 2,500,000 doses respectively (please, see related acts).

Update
On May 10, 2017, the Brazilian Foreign Trade Council issued Ordinance No 19 increasing the reduced import-duty quota on NCM 3908.10.24 to 7,000 tonnes for a twelve-month period starting on May 11, 2017. In the same state act, several new temporary tariff-rate quotas were established and some other tariff lines with reduced import-duty were modified (see related measures).

On December 13, 2017, the Brazilian Foreign Trade Council issued Resolution 94 revoking its decision of reducing the import tariff set on NCM 2929.10.30 for a 1,000-tonne quota.

On December 20, 2017, the Foreign Trade Council of Brazil issued Resolution 97, extending the reduced import quota on HS Codes 2921.11.21 and HS Code 3215.11.00 for a quota of 12,000 tonnes and 350 respectively. The new quota starts on January 23, 2018, and is valid for a twelve-month period.

On January 30, 2018, the Foreign Trade Council of Brazil adopted Resolution 3, extending the reduced import quota on HS Codes 2833.11.10 and 7606.12.90 for a quota of 910,000 and 2,937 tonnes respectively. The new quota starts on February 1, 2018, and is valid for twelve months.
