According to France, "[...] The aid measure must allow the development of electricity generation from solar energy in order to achieve the 2020 targets set by Directive 2009/28 / EC and in the multiannual programming of electricity generation investments. [...] On the basis of the estimated market prices, the tender prices and the selected peak powers, the aid budget was estimated at an annual amount of EUR 214 million. The exact amount depends on the actual market price, and the volume of electricity produced. [...] The four calls for tenders subject to the notification were launched between July 2011 and March 2013. The tender documents provide for a period of commissioning between September 2013 and May 2016." (translated from para. 4, 34 and 35 letter from the EC to France, Brussels 19.04.2017)
Based on the findings of the European Commission, "[...] Electricity is the subject of considerable trade between Member States. Any advantage given to a given mode of electricity production is therefore liable to distort competition and affect trade between Member States." (translated from para. 46 letter from the EC to the France, Brussels 119.04.2017)
In the GTA database the determination of whether a policy instrument discriminates against foreign commercial interests turns on whether it creates or alters the relative treatment of domestic firms versus foreign commercial interests. On this metric, the state aid proposed here is discriminatory because the state aid is not available to competing firms outside of the implementing jurisdiction.
