ANNOUNCED AS TEMPORARYNo
On May 17, 2017 the Court of International Trade ruled in the case of Sigvaris, Inc. versus United States that certain models of graduated compression arm sleeves and gauntlets are specially designed for the use or benefit of handicapped person, and therefore qualify for duty-free treatment under item 9817.00.96 in the tariff schedule. That ruling effectively eliminated the 14.6% duty that would otherwise be applied to these products if they were classified instead under item 6115.10.40. The court further determined that U.S. Customs and Border Protection had properly classified certain models of graduated compression hosiery under that latter item, and that these will remain subject to the higher duty.
