ANNOUNCED AS TEMPORARYNo
On February 10, 2017 the Court of International Trade ruled in Allstar Mktg. Grp., LLC v. United States that a polyester fleece knit article known as a Snuggie® is properly classified as a blanket under HTSUS 6301.40.00, and thus subject to an 8.5% duty. U.S. Customs and Border Protection had previously classified this item as other knitted garments of manmade fibers under HTSUS 6114.30.30 (14.9% duty). According to the CIT, this item is not classifiable as a garment due to physical characteristics and features that do not resemble a normal article of apparel but instead has the essential characteristics of a blanket.
