The herbicides are classified under code 389803 of the Common Nomenclature for Foreign Economic Activity of the Eurasian Economic Union.
During the period 2013-2015, the volume of imports of herbicides from the EU increased by 9.5% and a further 10.5 % in the first half of 2016, compared to the first half of 2015. During the analysed period, the share of imports from the EU in the total imports was significant--on average around 50%.
From July 2015 to June 2016, the herbicides from the EU were found to have been exported at dumping prices. According to preliminary estimates, the dumping margin was as high as 361,98 %.
These facts contributed, it has been argued, to the negative development of the supranational market of herbicides of the Eurasian Economic Union. They motivate the initiation of an anti-dumping investigation at the request of several companies of Russia, Belarus, and Kazakhstan.
On 31 May 2018, the Board of the Eurasian Economic Commission issued Decision No. 90 imposing a definitive duty on imports of herbicides from the European Union. The products subject to duties are classified under the following HS code subheadings: 3808.59.00.05, 3808.93.11.00, 3808.93.13.00, 3808.93.15.00, 3808.93.17.00, 3808.93.21.00, 3808.93.23.00, 3808.93.27.00, 3808.93.30.00, and 3808.93.90.00. The rate of duty is between 27.47% and 52.23%. The duty enters into force 30 days of from the date of publication, i.e. 30 June 2018. The duty is in force for a period of 5 years.
