On 23 May 2006, the Mexican Government initiated an anti-dumping investigation on imports of monobutyl ether from the United States.
The investigation was initiated upon request of the solely Mexican producer of Malathion: Tekchem S.A. de C.V. On 29 October 2007, before the the Mexican authorities issued its final determination, Cheminova A/S the Danish exporter of this product and the Mexican Minister of Economy announced the celebration of a 'price undertaking' and therefore the investigation was suspended.
On 22 May 2009, the Danish exporter Cheminova A/S requested the Mexican authorities to initiate a review of the price undertaking. Among others, Cheminova A/S argued that the circumstances that originated the initiation of the anti-dumping investigation had changed since Tekchem S.A. de C.V. the Mexican enterprise that requested the investigation had ceased to produce malathion.
Thus, on 15 October 2009, the Mexican Government, after reviewing the new circumstances in the malathion market, decided to eliminate the price undertaking and to conclude the anti-dumping investigation without the adoption of anti-dumping duties.
