Import tariff quota
On 26 May 2015, the Brazilian Foreign Trade Council (Camex) issued Resolution no. 50 introducing a tariff-rate quota on p-Xylene (NCM 2902.43.00). The duty was reduced from 4% to 0% for a quota of 90'000 tonne for the timeframe of 30 May 2015 until 25 November 2015.
List of Exceptions to the Common External Tariff
The good was included in the List of Exceptions to the Common External Tariff (LETEC) of Mercosur which is a mechanism that allows member states of Mercosur to apply customs duties that are lower or higher than otherwise listed in the Mercosur Common External Tariff schedule. However, the tariffs shall not surpass the ceilings given by the WTO. Decision CMC no. 58/10 gives Brazil the right to maintain a list of 100 such tariff codes based on the Mercosur Common Nomencalture (NCM) until 31 December 2015.
Camex had already introduced a tariff-rate quota on p-Xylene in 2014 (measure no. 8696) but with a lower quota. On 26 November 2015, the above mentioned measure was extended again by Camex Resolution no. 96 until 23 May 2016. This time, the quota stayed the same, i.e., 90'000 tonne duty-free. On 22 April 2016, the above mentioned measure was extended again by Camex Resolution No. 39 until 19 November 2016. The applied quota remains at 90'000 tonne duty-free
