Anti-dumping

On September 3rd, 2009, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, initiated an anti-dumping investigation on imports of acetone from Japan and Thailand.
The product subject to investigation is classified under the following HS code subheading: 2914.11.
This follows the application lodged by M/s. Hindustan Organic Chemicals Limited and supported by M/S SI Group India Ltd., the only two domestic producers of the subject good.
 
On February 16th, 2010, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its preliminary findings and recommended the imposition of a provisional anti-dumping duty on imports of acetone originating in Japan and Thailand.
On April 9th, 2010, the Indian Ministry of Finance issued the Customs Notification imposing this provisional anti-dumping duty (Notification No. 45/2010-Customs, 09.04.2010). The amount of the duty imposed on imports originating in Thailand is USD 168.28 per metric ton, at the exception of the producing company M/s PTT Phenol Company Limited whose exports are subject to a duty of USD 103.97 or 24.87 per metric ton (depending on the country of export and on the exporting company). The amount of the duty imposed on imports originating in Japan is USD 195.58 per metric ton, at the exception of the company M/s Mitsui Chemical Inc. whose exports are subject to a duty of USD 89.78 per metric ton. This provisional duty was effective upto and inclusive of October 8th, 2010.
 
On January 19th, 2011, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of acetone originating in Japan and Thailand.
On April 18th, 2011, the Indian Ministry of Finance issued the Customs Notification imposing this definitive anti-dumping duty (Notification No. 36/2011-Customs, 18.04.2011). The amount of the duty imposed on imports originating in Thailand is USD 85.85 per metric ton, at the exception of the company M/s PTT Phenol Company Limited whose exports are not subject to the payment of a duty. The amount of the duty imposed on imports originating in Japan is USD 94.96 per metric ton, at the exception of the company Mitsui Chemicals Inc. whose exports are not subject to the payment of a duty. This definitive duty is effective for a period of five years from the date of imposition of the provisional anti-dumping duty, i.e. from April 9th, 2010.
 
On April 7th, 2015, the Indian authorities initiated a sunset review of the above-mentioned anti-dumping duty imposed on imports of acetone originating in Japan and Thailand. This follows the application lodged by M/s Hindustan Organic Chemicals Limited and M/s SI Group India Ltd.
On April 22nd, 2015, the Indian authorities issued the notification of provisional extension of the anti-dumping duty imposed by Notification No. 36/2011-Customs dated April 18th, 2011 (Notification No. 16/2015-Customs (ADD), 22.04.2015). This duty remains into force upto and inclusive of April 8th, 2016.
