On 15 May 2013, the Indian Ministry of Chemicals and Fertilizers issued the Drugs (Price Control) Order, 2013 thereby bringing the prices of 328 essential drugs and their 680 formulations under price control*. Manufacturers are not allowed to charge prices higher than the calculated ceiling price. However, the Order exempts domestic or foreign manufacturers from such price control who have through their Research & Development in India developed a new drug or a new process for an existing drug or a new drug involving a new delivery system. Further, such exemption will be valid for 5 years from the day the drug is commercially produced.
* The list of drugs and formulations is as listed under the National List of Essential Medicines. Currently, the Ministry has fixed the ceiling prices of 509 formulations out of the 680 listed.
