On June 19th, 2015, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of polyethylene terephthalate, with intrinsic viscosity between 0.7 and 0.88 dL/g, from China, Chinese Taipei, India and Indonesia (Circular No. 39, 19.06.2015).
The product subject to investigation is classified under the following HS code: 3907.6000.
The complaint was lodged on April 30th, 2015 by M&G Polímeros Brasil S/A. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on June 22nd, 2015.
On October 22nd, 2015, the Brazilian Ministry of Development, Industry and Foreign Trade made a preliminary determination of dumping against imports of polyethylene terephthalate from China, Chinese Taipei, India and Indonesia without imposing a provisional measure (Circular No. 67, 22.10.2015). The investigation continues until the final determination. Circular No. 67 was published in the Federal Official Gazette of Brazil on October 23rd, 2015.
On 28 November 2016, the Brazilian authorities imposed a definitive anti-dumping duty on imports of the subject good from China, Chinese Taipei, India and Indonesia (Camex Resolution No. 121 of 2016). The rate of duty on imports from China is between USD 87.23 and 682.38 per tonne depending on the company. The rate of duty on imports from India is USD 193.78 or 468.97per tonne depending on the company. The rate of duty on imports from Indonesia is USD 304.42 per tonne. The rate of duty on imports from Chinese Taipei is USD 682.18 per tonne. The duty is in force for a period of five years.
