NoOn July 3rd, 2015, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of ethylene glycol monobutyl ether from Germany (Circular No. 44, 03.07.2015).
The product subject to investigation is classified under the following HS code: 2909.4310.
The complaint was lodged on April 30th, 2015 by Oxiteno Nordeste S.A. Indústria e Comércio and Oxiteno S.A. Indústria e Comércio. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on July 6th, 2015.
On November 5th, 2015, the Brazilian Ministry of Development, Industry and Foreign Trade made a preliminary determination of dumping against imports of ethylene glycol monobutyl ether from Germany without imposing a provisional measure (Circular Secex No. 72, 05.11.2015). The investigation continues until the final determination. Circular Secex No. 72 was published in the Federal Official Gazette of Brazil on November 6th, 2015.
On November 24th, 2015, the Brazilian authorities decided upon the imposition of a provisional anti-dumping duty on imports of ethylene glycol monobutyl ether from Germany (Resolution Camex No. 113, 24.11.2015). The rate of the duty is 24.7%.
This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on November 25th, 2015, and is applicable for a period of six months.
On 22 April 2016, the Brazilian authorities imposed a definitive anti-dumping duty on imports of the above-mentioned products from Germany (Resolution No. 37, 20/04/2016). The duty is ad valorem 27.5% and is in force for a period of five years.
On 22 April 2021, the Brazilian authorities initiated a sunset review of the definitive duty imposed on imports of the subject good from Germany. This follows the application lodged on 22 December 2020 by Oxiteno S.A. Indústria e Comércio. The duty will remain in force for the duration of the review.
On 20 April 2022, the Brazilian authorities issued a regulation extending the definitive duty imposed on imports of ethylene glycol monobutyl ether from Germany following the conclusion of the sunset review. The rate of duty ranges is 22.6%.
