Anti-dumping

On June 18th, 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, initiated an anti-dumping investigation on imports of purified terephthalic acid (PTA), including its variants medium quality terephthalic acid (MTA) and qualified terephthalic acid (QTA), from China, Chinese Taipei, Indonesia, Iran and Malaysia.
The products subject to investigation are classified under the following HS code: 2917.3600.
This follows the application lodged by M/s MCC PTA India Corp. Pvt. Ltd and M/s Reliance Industries Limited on behalf of the domestic industry.

On 12 November 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, issued its preliminary findings and recommended the imposition of a provisional anti-dumping duty on imports of the subject goods originating in or exported from China, Iran, Indonesia, Malaysia and Chinese Taipei.

On 10 December 2015, the Indian Ministry of Finance issued the Customs Notification imposing this provisional anti-dumping duty (Notification No. 60/2015-Customs (ADD), 10.12.2015). The amount of the duty imposed on imports originating in or exported from China is USD 80.13 per metric ton. The amount of the duty imposed on imports originating in or exported from Indonesia is USD 76.13 per metric ton. The amount of the duty imposed on imports originating in or exported from Iran is USD 108.28 per metric ton. The amount of the duty imposed on imports originating in or exported from Malaysia is USD 98.15 per metric ton. The amount of the duty imposed on imports originating in or exported from Chinese Taipei is USD 56.94 per metric ton. This provisional duty is effective for a period of six months.
 
On 5 July 2016, the Indian Ministry of Finance issued the Customs Notification imposing a definitive anti-dumping duty on above products from China, Iran, Indonesia, Malaysia and Chinese Taipei (Notification No. 28/2016-Customs (ADD), 05.07.2016). The amount of duty imposed on imports originating in or exported from China is USD 95.70 or USD 97.60 per metric ton depending on the company. The amount of duty imposed on imports originating in or exported from Indonesia is USD 168.76 or USD 83.08 per metric ton depending on the company. The amount of duty imposed on imports originating in or exported from Chinese Taipei is between USD 85.87 and USD 153.60 per metric ton depending on the company. The amount of duty imposed on imports originating in or exported from Iran is USD 102.86 per metric ton. The amount of duty imposed on imports originating in or exported from Malaysia is USD 98.48 per metric ton. This definitive duty is effective for a period of five years from the date of imposition of the above provisional duty, i.e. 10 December 2015.
