Anti-dumping

On 7 April 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, initiated an anti-dumping investigation on imports of methylene chloride (also known as dichloromethane or methylene dichloride), a colorless liquid used as a solvent predominantly, from China and Russia.
The product subject to investigation is classified under the following HS code: 2903.1200.
This follows the application lodged by M/s Chemplast Sanmar Ltd. and M/s Gujarat Fluorochemicals Ltd., companies that account for more than 50% of the domestic production of the subject good.

On 30 October 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, issued its preliminary findings and recommended the imposition of a provisional anti-dumping duty on imports of the subject goods originating in or exported from China and Russia.

On 8 December 2015, the Indian Ministry of Finance issued the Customs Notification imposing this provisional anti-dumping duty (Notification No. 58/2015-Customs (ADD), 08.12.2015). The amount of the duty imposed on imports originating in or exported from China is between USD 144.41 and USD 232.47 per metric ton depending on the company. The amount of the duty imposed on imports originating in or exported from Russia is USD 194.43 per metric ton. This provisional duty is effective for a period of six months.
 
On 31 May 2016, the Indian Ministry of Finance issued the Customs Notification imposing a definitive anti-dumping duty on above products from China and Russia (Notification No. 21/2016-Customs (ADD), 31.05.2016). The amount of duty imposed on imports originating in or exported from China is between USD 122.14 and USD 279.78 per metric ton depending on the company. The amount of duty imposed on imports originating in or exported from Russia is USD 219 per metric ton. This definitive duty is effective for a period of five years from the date of imposition of the above provisional duty, i.e. 8 December 2015.

On 31 August 2020, the Indian authorities initiated a sunset review of the definitive duty imposed on imports of the subject good from China. This follows the application lodged by Gujarat Fluorochemicals Ltd., Sree Rayalaseema Alkalies and Allied Chemicals Ltd and Chemplast Sanmar Ltd. No sunset review was initiated on imports of the subject good from Russia and the duty will therefore expire on 8 December 2020.
