Anti-dumping

On January 8, 2008, the Argentinian authorities decided to initiate an anti-dumping investigation on imports of compact air conditioning equipment (capacity up to 6,500 frigorías per hour, i.e. up to 26,000 BTU per hour) from Thailand (Resolution 2/2008, 08.01.2008).
The products subject to investigation are classified under the following HS codes: 8415.1019, 8418.6110, 8415.8300 and 8415.1011.
The complaint was lodged on February 5, 2007 by the Association of Argentinian Electronics Factories (Asociación de Fábricas Argentinas de Terminales de Electrónica - AFARTE). The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on January 11, 2008.
On February 24, 2009, the Argentinian authorities decided to impose a provisional anti-dumping duty on imports of the above-mentioned products originating in Thailand (Resolution 57/2009, 24.02.2009). The duty takes the form of a minimum FOB export price: of USD 476.89 per piece for items with capacity up to 2,500 frigorías per hour (i.e. up to 10,000 BTU per hour) and of USD 526.74 per piece for items with capacity higher than 2,500 frigorías per hour up to 5,000 frigorías per hour (i.e. up to 20,000 BTU per hour). This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on February 26, 2009, and is applicable for a period of four months.
On June 7, 2009, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of the above-mentioned products originating in Thailand (Resolution 245/2009, 07.06.2009). This definitive duty is identical to the provisional duty, i.e. takes the form of a minimum FOB export price: of USD 476.89 per piece for items with capacity up to 2,500 frigorías per hour (i.e. up to 10,000 BTU per hour) and of USD 526.74 per piece for items with capacity higher than 2,500 frigorías per hour up to 5,000 frigorías per hour (i.e. up to 20,000 BTU per hour). This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on July 9, 2009, and is applicable for a period of five years.
On July 8, 2014, the Argentinian authorities decided to initiate a sunset review of the anti-dumping duty imposed on June 7, 2009 by Resolution 245/2009 (Resolution 358/2014, 08.07.2014). This follows the request lodged by the Association of Argentinian Electronics Factories (Asociación de Fábricas Argentinas de Terminales de Electrónica - AFARTE). The review started on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on September 22, 2014. The existing anti-dumping duty remains in force during the review.
 
On 7 January 2016, the Argentinian authorities decided to extend the definitive anti-dumping duty on imports of certain air conditioning equipment with a maximum capacity 6,500 frigorías per hour falling under tariff heading 8415.10.19 from Thailand (Resolution 1900/2015). The rate of the definitive duty imposed is 85% of the FOB value. This definitive anti-dumping duty is applicable for a period of five years.
