EC: Definitive (resp. extension of) anti-dumping duty on imports of certain welded tubes and pipes of iron or non-alloy steel from Belarus, China, Russia and Ukraine and subsequent extension (except for Ukraine); Proceeding against imports originating in Bosnia and Herzegovina and Turkey without imposition (resp. extension) of any duty
 
On September 26, 2007, the European Commission announced the initiation of an anti-dumping investigation on imports of f certain welded tubes and pipes of iron or non-alloy steel from Belarus, Bosnia and Herzegovina, China and Russia (Notice No 2007/C 226/04). The products subject to investigation are classified under the following HS codes: ex 7306.3041, ex 7306.3049, ex 7306.3072 and ex 7306.3077. The exact definition is as follows:welded tubes and pipes, of iron or non-alloy steel, of circular cross-section and of an external diameter not exceeding 168.3mm, excluding tubes and pipes of a kind used for oil or gas pipelines, of a kind used in drilling for oil or gas, or with attached fittings for use in civil aircraft, other than precision tubes.
The complaint was lodged on August 20, 2007 by the Defence Committee of the welded steel tubes industry of the European Union on behalf of producers representing more than 50% of the EU production of the subject goods.
On September 26, 2007 the European Commission also announced the initiation of a sunset review of the anti-dumping measure imposed on imports of the above-mentioned goods (i.e. certain welded tubes and pipes of iron or non-alloy steel) originating in Thailand, Turkey and Ukraine.
On December 16, 2008, the European authorities decided to impose a definitive anti-dumping duty on imports of the above-mentioned goods originating in Belarus, China and Russia, and to extend the existing anti-dumping duty imposed on imports of the same products originating in Thailand and Ukraine (Council Regulation (EC) No. 1256/2008, 16.12.2008). The rate of the duty imposed on imports originating in Belarus is 38.1% of the net free-at-Community-frontier price. The rate of the duty imposed on imports originating in China is 90.6% of the net free-at-Community-frontier price. The rate of the duty imposed on imports originating in Russia is 20.5% of the net free-at-Community-frontier price, at the exception of the groups OMK Group and TMK Group whose subsidiaries' exports are subject to a duty of 10.1% and 16.8% respectively. The rate of the duty imposed on imports originating in Thailand is 35.2% of the net free-at-Community-frontier price, at the exception of the company Saha Thai Steel Pipe Co. Ltd whose exports are subject to a duty of 21.7%. The rate of the duty imposed on imports originating in Ukraine is 44.1% of the net free-at-Community-frontier price, at the exception of the companies OJSC Interpipe Nihnedeneprovsky Tube Rolling Plant and OJSC Interpipe Novomoskovsk Pipe Production Plant whose exports are subject to a duty of 10.7%. This duty entered into force on the day following the publication of the resolution in the Official Journal of the European Union (L 343), i.e. on December 20, 2008.
The proceeding concerning imports originating in Bosnia and Herzegovina is terminated without imposition of a duty. The sunset review concerning imports originating in Turkey is terminated without extension of the duty.
 
On December 19, 2013, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed by Council Regulation (EC) No. 1256/2008 dated 16.12.2008 on imports of certain welded tubes and pipes of iron or non-alloy steel originating in Belarus, China, Russia and Ukraine (Notice No 2013/C 372/10). The request for the review was lodged on September 18, 2013 by the Defence Committee of the welded steel tubes industry of the European Union on behalf of producers representing more than 25% of the EU production of the subject goods.
No application was lodged for the review concerning imports originating in Thailand. Thus, the anti-dumping duty imposed Council Regulation (EC) No. 1256/2008 dated 16.12.2008 on imports of certain welded tubes and pipes of iron or non-alloy steel originating in Thailand expired on December 20, 2013 (Notice No 2013/C 372/11).
On January 26, 2015, the European authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of certain welded tubes and pipes of iron or non-alloy steel from Belarus, China and Russia (Commission Implementing Regulation (EU) No 2015/110, 26.01.2015). The rate of the duty imposed on imports originating in Belarus remains 38.1% of the net free-at-Union-frontier price. The rate of the duty imposed on imports originating in China remains 90.6% of the net free-at-Union-frontier price. The rate of the duty imposed on imports originating in Russia remains 20.5% of the net free-at-Union-frontier price, at the exception of the groups OMK Group and TMK Group whose subsidiaries' exports are still subject to a duty of 10.1% and 16.8% respectively. This extension entered into force on the day following the publication of the resolution in the Official Journal of the European Union (L 20), i.e. on January 28, 2015.
The anti-dumping duty concerning imports originating in Ukraine was not extended and thus expired.
