Anti-dumping

On December 1, 2008, the European authorities decided to impose a definitive anti-dumping duty on imports of citric acid originating in China (Council Regulation (EC) No. 1193/2008, 01.12.2008). This follows an anti-dumping investigation initiated on 4 September 2007. The products subject to anti-dumping duties are classified under the following HS codes: 2918.1400 and ex 2918.1500. The rate of this definitive duty ranges from 6.6% to 42.7% of the net free-at-Union-frontier price, depending on the company. This duty entered into force on the day following the publication of the regulation in the Official Journal of the European Union (L 323), i.e. on December 4, 2008. 

On November 30, 2013, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed by Council Regulation (EC) No. 1193/2008 dated 01.12.2008 on imports of citric acid originating in China (Notice No 2013/C 351/06). The application for the review was lodged on August 2, 2013 by SA Citrique Belge and Jungbunzlauer Austria AG on behalf of producers representing 100% of the EU production of the subject good.
On January 21, 2015, the European authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of citric acid originating in China (Commission Implementing Regulation (EU) No 2015/82, 21.01.2015). The rate of the duty ranges from 15.3% to 42.7% of the net free-at-Union-frontier price, depending on the company. This extension entered into force on the day following the publication of the resolution in the Official Journal of the European Union (L 15), i.e. on January 23, 2015.
On January 21, 2015, the European authorities also accepted the undertakings offered by certain exporting producers in relation with this anti-dumping investigation (Commission Implementing Decision (EU) No 2015/87, 21.01.2015). Commission Implementing Decision (EU) No 2015/87 was published in the Official Journal of the European Union (L 15) on January 22, 2015.

On 20 January 2020, the European Commission initiated a sunset review of the anti-dumping duty imposed on imports of citric acid originating in China. The investigation follows the application lodged on 21 October 2019 by N.V. Citrique Belge S.A. and Jungbunzlauer Austria AG.

On 15 April 2021, the European Commission issued a regulation extending the definitive duty imposed on imports of citric from China following the conclusion of the sunset review. The rate of duty ranges from 15.3% to 42.7% of the net free-at-Union-frontier price before duty, depending on the company. The regulation extending the definitive duty entered into force on 16 April 2021.
