On May 29, 2014, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, initiated an anti-subsidy investigation on imports of castings for wind operated electricity generators (whether or not machined, in raw, finished or sub-assembled form, or as a part of a sub-assembly, or as a part of an equipment/component meant for wind-operated electricity generators) from China.
The products subject to investigation are classified under the following HS code subheading: 8503.
This follows the application lodged by M/s Larsen & Toubro Limited, a domestic producer of the investigated good representing more than 50% of the total domestic production.
On May 27th, 2015, the Indian authorities extended the time for completing the investigation up to November 28th, 2015.
On 19 January 2016, the Indian Ministry of Finance issued the Customs Notification imposing this definitive countervailing duty on imports of certain castings for wind operated electricity generators from China (Notification No. 1/2016-Customs (CVD), 19.01.2016). The products subject to the definitive duty are classified under the following HS code subheading: 8483.40.00, 8503.00.10 and 8503.00.90. The amount of the duty imposed on imports originating in or exported from China is 8.78% or 13.44% of the landed value depending on the company. This definitive duty is effective for a period of five years.
