NoOn October 5, 2012, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate a sunset review of the anti-dumping duty imposed on imports of semi-rigid packaging board, coated, duplex and triplex types of weight less than 200 g/m2 from Chile (Circular No. 52, 05.10.2012).
The products subject to investigation are classified under the following HS codes: 4810.1389, 4810.1989 and 4810.9290.
The application for the review was lodged on July 10, 2012 by Klabin S/A, Papirus Indústria de Papel S/A and Suzano Papel e Celulose S/A. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on October 8, 2012.
On July 12, 2013, the Brazilian Ministry of Development, Industry and Foreign Trade made a preliminary determination of dumping against imports of coated cardboards originating in Chile (Circular No. 37, 12.07.2013). This preliminary determination aims at encouraging producers/exporters to voluntarily assume price undertakings. The investigation continues until the final determination. Circular No. 37 was published in the Federal Official Gazette of Brazil on July 15, 2013.
On September 12, 2013, the Brazilian authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of coated cardboards originating in Chile (Resolution No. 71, 12.09.2013). The duty takes the form of price undertakings. For more details, see Resolution No. 71 dated September 12, 2013. This measure entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on September 13, 2013, and is applicable for a period of five years.
On 13 September 2018, the Brazilian authorities initiated a sunset review of the definitive duty in the form of a price comment agreement imposed on imports of the subject good from Chile. This follows the application lodged on 30 April 2018 by Klabin S.A., Papirus Indústria de Papel S.A. and Suzano Papel e Celulose S.A. The duty will remain in force for the duration of the review.
On 12 July 2019, the Brazilian authorities extended the antidumping duty imposed on imports of semi-rigid cartons from Chile following the conclusion of a sunset review. The rate of duty is USD 122.28 or 189.08 per tonne depending on the company. The duty is in force for a period of five years.
