Anti-dumping

On March 18, 2008, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of viscose fibres (discontinuous artificial fibres of viscose for spinning, not carded, combed nor transformed otherwise) from Austria, China, Chinese Taipei, Indonesia and Thailand (Circular No. 18, 18.03.2008).
The products subject to investigation are classified under the following HS code: 5504.1000.
The complaint was lodged on October 26, 2007 by Vicunha Têxtil S.A. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on March 20, 2008.
On October 3, 2008, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of viscose fibres from Austria, China and Chinese Taipei (Resolution No. 61, 03.10.2008). The amount of the duty imposed on imports originating in Austria is USD 0.33 per kilogram. The amount of the duty imposed on imports originating in China is USD 0.18 per kilogram. The amount of the duty imposed on imports originating in Chinese Taipei is USD 0.39 per kilogram. This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on October 9, 2008, and is applicable for a period of six months. No provisional duty was imposed on imports originating in Indonesia and Thailand.
On March 3, 2009, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to extend for up to six months, from March 20, 2009, the investigation period to determine the existence of dumping in exports of viscose fibres from Austria, China, Chinese Taipei, Indonesia and Thailand (Circular No. 12, 03.03.2009). Circular SECEX No. 12 was published in the Federal Official Gazette of Brazil on March 5, 2009.
On April 8, 2009, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of viscose fibres from Austria, China, Chinese Taipei, Indonesia and Thailand (Resolution No. 20, 08.04.2009). The amount of the duty imposed on imports originating in Austria is USD 0.47 per kilogram, at the exception of the company Lenzing Aktiengesellschaft whose exports are subject to a duty of USD 0.10 per kilogram. The amount of the duty imposed on imports originating in China is USD 0.34 per kilogram. The amount of the duty imposed on imports originating in Chinese Taipei is USD 1.35 per kilogram. The amount of the duty imposed on imports originating in Indonesia is USD 0.45 per kilogram, at the exception of the company P.T. Indo-Bharat Rayon whose exports are subject to a duty of USD 0.06 per kilogram. The amount of the duty imposed on imports originating in Thailand is USD 0.64 per kilogram, at the exception of the company Thai Rayon Public Co. Ltd. whose exports are subject to a duty of USD 0.10 per kilogram. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on April 9, 2009, and is applicable for a period of five years.
On December 18, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to suspend the definitive duty imposed by Resolution No. 20 dated 08.04.2009 on imports of viscose fibres from Austria, China, Chinese Taipei, Indonesia and Thailand (Resolution No. 116, 18.12.2013). The reason for the suspension is the interruption of the national production. Resolution CAMEX No. 116 was published in the Federal Official Gazette of Brazil on December 20, 2013.
The definitive duty imposed by Resolution No. 20 dated April 8, 2009 expired on April 8, 2014.
