Anti-dumping

On September 18, 2014, the Brazilian authorities, after having conducted an expiry review, decided upon the continuation of the anti-dumping duty imposed on imports of phenol (industrial grade) from the European Union and the United States of America (Resolution No. 82, 18.09.2014).
The product subject to the duty is classified under the following HS code: 2907.1100.
The rate of the duty imposed on imports originating in the European Union is 103.5%. The rate of the duty imposed on imports originating in the United States of America is 68.2%, at the exception of the company Ineos Phenol whose exports are subject to a duty of 54.9%.
This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on September 19, 2014, and is applicable for a period of five years.
According to the UN Comtrade Database, in 2013 no EU member states exported goods classified under HS code 2907.11 to Brazil with a trade value over USD 1 million. Germany exported goods classified under HS code 2907.11 to Brazil for USD 51,113; Hungary for USD 151; Spain for USD 122; and France for USD 112. The United States of America exported goods classified under HS code 2907.11 to Brazil for USD 2,714.
This duty follows an expiry review requested on April 10, 2013 by Rhodia Poliamida e Especialidades Ltda. A review was then initiated by the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade on September 27, 2013 (Circular No. 53, 27.09.2013). The review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on September 30, 2013.
The original anti-dumping duty entered into force on October 16, 2002 (Resolution No. 24, 15.10.2002). A first extension of five years was decided on September 16, 2008 (Resolution No. 59, 16.09.2008).
