Anti-dumping

On September 9, 2009, the Argentinian authorities decided to initiate an anti-dumping investigation on imports of gas screw compressors (other than air), including those used in refrigeration systems, capable of volumetric displacement greater than or equal to 200 m3/h, from Brazil (Resolution 297/2009, 09.09.2009).
The products subject to investigation are classified under the following HS codes: 8414.8032 and 8414.3099.
The complaint was lodged by VMC Refrigeración S.A. The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on September 16, 2009.
On July 6, 2010, the Argentinian authorities decided to impose a provisional anti-dumping duty on imports of the investigated products from Brazil (Resolution 2/2010, 06.07.2010).
The rate of the provisional duty is 38% of the declared FOB price. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on July 14, 2010, and is applicable for a period of six months.
On March 14, 2011, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of the investigated products from Brazil (Resolution 91/2011, 14.03.2011).
The rate of the definitive duty is 79% of the declared FOB price for all Brazilian exporters, at the exception of the Brazilian company Mayekawa do Brasil Refrigeração LTDA., whose exports are subject to the payment of an anti-dumping duty of 33% of the declared FOB price. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on March 17, 2011, and is applicable for a period of five years.

On 16 March 2016, the Argentinian authorities initiated a sunset review of the anti-dumping measure imposed on imports of above-mentioned products (Resolución 60/2016). This follows the request lodged by VMC Refrigeración S.A. The duty will remain in force for the duration of this investigation.
 
On 15 March 2017, the Argentinian authorities extended the definitive anti-dumping duty imposed on imports of the subject good from Brazil. The rate of duty is 51% ad valorem. This is with the exception of the company Mayekawa do Brasil Refrigeração LTDA., whose exports are subject to anti-dumping duty of 33% of the declared FOB price. The measure is in force for a period of five years.
