Anti-subsidy

On November 1, 2012, the Ministry of Commerce of the People's Republic of China decided to initiate an anti-subsidy investigation on imports of solar-grade polysilicon from the European Union (MOFCOM Announcement No. 70 of 2012, 01.11.2012).
The product subject to investigation is classified under the following HS code: 2804.6190.
The complaint was lodged on September 17, 2012 by Jiangsu Zhongneng Polysilicon Technology Development Co., Ltd., Jiangxi LDK Photovoltaic Silicon Technology Co., Ltd., China Silicon Corporation Ltd. and Chongqing Daqo New Energy Co., Ltd. on behalf of the domestic industry.

According to the UN Comtrade Database, in 2011 the following EU member states exported goods classified under HS code 2804.61 to China with a trade value over USD 1 million: Germany (USD 755.83 million), Italy (USD 113.68 million), Finland (USD 4.39 million), Spain (USD 3.75 million), the Netherlands (USD 2.65 million) and France (USD 1.12 million).
On January 24, 2014, the Ministry of Commerce of the People's Republic of China decided not to impose a provisional countervailing duty on imports of solar-grade polysilicon originating in the European Union even evidence of subsidisation has been found (MOFCOM Announcement No. 26 of 2014, 24.01.2014). To make such a decision the Chinese authorities indicated that they took into account the particular market situation.
On April 30, 2014, the Ministry of Commerce of the People's Republic of China decided to impose a definitive countervailing duty on imports of solar-grade polysilicon originating in the European Union (MOFCOM Announcement No. 26 of 2014, 30.04.2014). The rate of this definitive countervailing duty is 1.2%. This duty entered into force on May 1, 2014 and is applicable for a period of two years.
 
On 1 May 2016, the Ministry of Commerce of the People's Republic of China initiated a sunset review of the countervailing duty imposed on imports of the above good from the European Union (MOFCOM Announcement No. 14 of 2016). It follows the application lodged on 29 February 2016 by Jiangsu Zhongneng Polysilicon Technology Development Co. Ltd., Jiangxi LDK PV Silicon Technology Co., Ltd., China Silicon Corporation Ltd. and Chongqing Daqo New Energy Co., Ltd. on behalf of the industry of the subject good. The existing countervailing duty remains in force during the review.

On 1 May 2017, the Ministry of Commerce of the People’s Republic of China extended the countervailing duty on imports of the subject good from the European Union for a period of 18 months following the conclusion of the above sunset review. The rate of duty imposed on imports of the subject good remains at the same level as imposed by Announcement No. 26 of 2014.
