Sanitary and phytosanitary measure

On 3 June 2013, the Indonesian Ministry of Agriculture legislated regulation 64/Permentan/OT.140/5/2013, which sets requirements for the importation of organic food to Indonesia.
As stated in article 12 of the regulation, 'organic products as a result of importation into the territory of the Republic of Indonesia are required to:

  • attach transaction certificate;
  • attach health certificate or certificate of free sale.' (English translation by USDA Indonesia)

The transaction certificate described above is issued either by a local organic certification institute (LSO) or a foreign domicile in Indonesia. However, the institution has to possess a certificate from the National Accrediation Committee (KAN).
The new rules came into force one year later, i.e. 3 June 2014.
As the HS code does not offer a separation of organic and nonorganic agricultural products, and as these are in many cases close substitutes of each other, the affected sectors and tariff lines are based on all relevant imported agricultural goods to Indonesia.
