On April 22, 2013, the Indian Directorate General of safeguards initiated a safeguard investigation on imports of seamless pipes, tubes and hollow profiles (of iron or non-alloy steel).
The products subject to investigation are classified under the following HS codes: 7304.1910, 7304.1920, 7304.1990, 7304.2310, 7304.2390, 7304.2910, 7304.2990, 7304.3111, 7304.3119, 7304.3121, 7304.3129, 7304.3131, 7304.3139, 7304.3911, 7304.3919, 7304.3921, 7304.3929, 7304.3931, 7304.3939, 7304.5110, 7304.5120, 7304.5130, 7304.5910, 7304.5920, 7304.5930 and 7304.9000.
This follows the application lodged by M/s. Jindal Saw Ltd. and M/s ISMT, companies which account for more than 50% of the domestic production of the subject goods.
On March 11, 2014, the Indian Directorate General of safeguards issued its final findings and recommended the imposition of a safeguard duty for two and a half years on the imports of tubes, pipes and hollow profiles, seamless of iron, alloy or non-alloy steel (other than cast iron and stainless steel), whether hot finished or cold drawn or cold rolled, of external diameter not exceeding 273.1 mm.
On August 13, 2014, the Indian Ministry of Finance issued the Customs Notification imposing this safeguard duty (Notification No. 02/2014-Customs (SG), 13.08.2014). The rate of the duty is 20% during the first year (up to August 12, 2015 inclusive), 10% during the second year (up to August 12, 2016 inclusive) and 5% during six more months (up to February 12, 2017 inclusive).
