Anti-subsidy

On February 12, 2013, the Australian Customs and Border Protection Service initiated an anti-subsidy investigation on imports of flat rolled products of iron, non-alloy steel or non-heat treated alloy steel of a kind commonly referred to as Quench and Tempered (Q&T) Green Feed (of a width greater than 600mm, with a thickness equal to or greater than 4.75mm, not further worked than hot rolled, not in coils, with or without patterns in relief) from China (Australian Customs Dumping Notice No. 2013/18).
The following goods are excluded from the investigation: 250 megapascal (MPa) yield strength grades of plate steel with a thickness greater than 150mm, 350 MPa yield strength grades of plate steel with a thickness greater than 100mm, Q & T Green Feed grades of plate steel with a thickness greater than 105mm and heat treated Q & T grades of plate steel.
The products subject to investigation are classified under the following HS codes: 7208.4000, 7208.5100, 7208.5200 and 7225.4000.
The complaint was lodged on December 21, 2012 by Bluescope Steel Limited.
An anti-dumping investigation was simultaneously initiated on imports of the same products originating in China, Chinese Taipei, Indonesia, Japan and South Korea (see measure 4156).
On February 28, 2013, the Australian Customs and Border Protection Service published a notice to clarify which goods are subject to investigation (Australian Customs Dumping Notice No. 2013/20).
On May 31, 2013, the Australian Customs and Border Protection Service extended the time granted to issue the Statement of Essential Facts (Australian Customs Dumping Notice No. 2013/40).
On August 1, 2013, the Australian Anti-Dumping Commission issued the Statement of Essential Facts (SEF Report No. 198).
On September 16, 2013, the Australian Anti-Dumping Commission published its Final Report (Final Report No. 198).
On December 19, 2013, the Australian authorities imposed a definitive countervailing duty on the goods subject to investigation (Anti-Dumping Notice No. 2013/72). The rate of the duty is 54.9%; this duty is however a combination of an anti-dumping duty and of a countervailing duty imposed simultaneously (see measure 4156). The subsidy margin of imports originating in China has been found to be 'only' 36.9% while the dumping margin has been found to be 22.1%. Goods produced by the Chinese company Shandong Iron and Steel, Jinan Company (JIGANG) have been found to have a subsidy margin of only 2.6% (and a dumping margin lower than 2%); hence, they are not subject to the payment of any duty.
 
After Balcombe Engineering Pty Ltd., a Chinese exporter of the goods subject to the duty, lodged an application for exemption from the duty imposed on December 19, 2013 for goods classified under HS code 7208.5100 (plate steel produced to ASTMInternational standard A516 GR70), the Commissioner of the Anti-Dumping Commission started an exemption inquiry on March 12, 2014 (Anti-Dumping Notice No. 2014/19).
After Adsteel Brokers Pty Ltd., a Chinese exporter of the goods subject to the duty, lodged an application for exemption from the duty imposed on December 19, 2013 for goods classified under HS code 7208.5100 (plate steel specified by Japanese Industry Standard (JIS) G4051-S45C), the Commissioner of the Anti-Dumping Commission started an exemption inquiry on April 10, 2014 (Anti-Dumping Notice No. 2014/28).
After Adsteel Brokers Pty Ltd., a Chinese exporter of the goods subject to the duty, lodged an application for exemption from the duty imposed on December 19, 2013 for goods classified under HS code 7208.5100 (plate steel specified to the ASTM International A516-70 standard), the Commissioner of the Anti-Dumping Commission started an exemption inquiry on April 10, 2014 (Anti-Dumping Notice No. 2014/29).
