On November 23, 2010, the Costa Rican authorities initiated a sunset review of the anti-dumping duty imposed on imports of water-based latex paint from the United States of America (Resolution No. 66-2010, 23.11.2010). Resolution No. 66-2010 was published in the Official Journal of Costa Rica 'La Gaceta' on December 15, 2010.
The product subject to investigation is classified under the following HS code: 3209.9010.
The request for a sunset review was lodged on September 10, 2010 by Reca Química S.A.
On November 21, 2011, the Costa Rican authorities issued their final findings of the sunset review. They recommended the continuation of the existing anti-dumping measure for a period of five years starting from February 1, 2011 (Resolution No. 0045-2011, 21.11.2011).
The duty is an ad valorem duty of 516% of the CIF value or, as preferential residual measure to prevent trade from being distorted more than necessary, the difference between the FOB price declared by the importer and the reference FOB price set at USD 10.52 per gallon. It is specified in the resolution that exports of the company Celera Group will be charged an ad valorem duty of 516% of the CIF value. Resolution No. 0045-2011 was published in the Official Journal of Costa Rica 'La Gaceta' on January 5, 2012.
The original anti-dumping duty was imposed on January 18, 2007 by Resolution No. 006-2007. Resolution No. 006-2007 was published in the Official Journal of Costa Rica 'La Gaceta' on January 30, 2007.
On 1 February 2016, the the Costa Rican authorities terminated the above anti-dumping duty on imports of the subject good from the United States. The measure is terminated following its expiry.
