On 14 August 2014, the Ministry of Commerce and the General Administration of Customs jointly issued the "Announcement of Suspending the Application of the Importation of Solar Polysilicon for Processing Trade" (MOFCOM Announcement '2014' No.58).
 
According to the announcement, MOFCOM will not approve the importation of solar polysilicon (HS codes: 2804.61.90.12, 2804.61.90.13, 2804.61.90.92, 2804.61.90.93) under processing trade. The contracts approved by MOFCOM before 1 September 2014 are allowed to be enforced within its terms.
 
Since China has applied anti-dumping duties to solar polysilicon producers from the EU, South Korea and the US in 2014, there has been an import surge of solar polysilicon under the catogery of "processing trade". The termrefers to the business activity of importing all or part of the raw and auxiliary materials, parts and components, accessories, and packaging materials from abroad in bond, and re-exporting the finished products after processing or assembly by enterprises within the mainland.
 
With the implementation of this measure, the circumvention of anti-dumping duties on solar polysilicon via this route will no longer be possible.
