Anti-dumping

On June 27, 2014, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of films, plates, sheets, foils and strips of poly (ethylene terephthalate) (biaxially oriented, thickness less than 5 micrometres, metallised or not) from China, Egypt and India (Circular No. 40, 27.06.2014).
The products subject to investigation are classified under the following HS codes: 3920.6219, 3920.6291 and 3920.6299.
The complaint was lodged on April 30, 2014 by Terphane Ltda., which is the sole domestic producer of the goods under scrutiny.
The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on June 30, 2014.
 
On October 27, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade made a preliminary determination of dumping against imports of poly (ethylene terephthalate) films (PET films) originating in China, Egypt and India (Circular No. 65, 27.10.2014). Circular No. 65 was published in the Federal Official Gazette of Brazil on October 28, 2014.
 
On November 21st, 2014, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of PET films from China, Egypt and India (Resolution No. 105, 21.11.2014).
The amount of the duty imposed on imports originating in Egypt is USD 435.45 per metric ton, at the exception of the company Flex P Films (Egypt) SAE whose exports are subject to a duty of USD 95.88 per metric ton. The amount of the duty imposed on imports originating in India ranges from USD 195.58 to USD 737.44 per metric ton, depending on the company. The amount of the duty imposed on imports originating in China is USD 820.60 per metric ton.
This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on November 24th, 2014, and is applicable for a period of six months.
 
On April 24th, 2015, the Brazilian authorities decided to extend for up to eight months, from April 30th, 2015, the investigation period to determine the existence of dumping in exports of PET films from China, Egypt and India (Circular No. 27, 24.04.2015). Circular No. 27 was published in the Federal Official Gazette of Brazil on April 27th, 2015.
 
On May 21st, 2015, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of PET films from China, Egypt and India (Resolution No. 46, 21.05.2015).
The amount of the duty imposed on imports originating in India ranges from USD 222.15 to USD 854.36 per metric ton, depending on the company. The amount of the duty imposed on imports originating in Egypt is USD 483.83 per metric ton, at the exception of the company Flex P. Films (Egypt) S.A.E whose exports are subject to a duty of USD 419.45 per metric ton. The amount of the duty imposed on imports originating in China is USD 946.36 per metric ton.
This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on May 22nd, 2015, and is applicable for a period of five years.
