Anti-dumping

On May 23, 2014, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of Emulsion Styrene-Butadiene Rubber (E-SBR) from the European Union (Circular No. 24, 23.05.2014).


The products subject to investigation are classified under the following HS codes: 4002.1911 and 4002.1919.

The complaint was lodged on April 30, 2014 by Lanxess Elastômeros do Brasil S/A, which is the sole domestic producer of the goods under scrutiny.

The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on May 26, 2014.

According to the UN Comtrade Database, in 2013 the following EU members exported Emulsion Styrene-Butadiene Rubber to Brazil with a trade value over USD 1 million: Poland (USD 39 million), Germany (USD 26 million), the United Kingdom of Great Britain and Northern Ireland (USD 20 million), Czech Republic (USD 12 million), France (USD 10 million), Italy (USD 3 million) and Belgium (USD 1 million).

On September 23, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade made a preliminary determination of dumping against imports of Emulsion Styrene-Butadiene Rubber (E-SBR) from the European Union (Circular No. 55, 23.09.2014). Up to April 20, 2015 no provisional duty was imposed yet. The investigation continues until the final determination. Circular No. 55 was published in the Federal Official Gazette of Brazil on September 24, 2014.

On March 24, 2015, the Brazilian authorities decided to extend for up to eight months, from March 26, 2015, the investigation period to determine the existence of dumping in exports of Emulsion Styrene-Butadiene Rubber from the European Union (Circular No. 19, 24.03.2015). Circular No. 19 was published in the Federal Official Gazette of Brazil on March 25, 2015.

On November 19th, 2015, the Brazilian authorities decided upon the imposition of a definitive anti-dumping duty on imports of Emulsion Styrene-Butadiene Rubber (E-SBR) from the European Union (Resolution Camex No. 110, 19.11.2015). The rate of the duty is 36.4%, at the exception of the following companies whose exports are subject to a preferential treatment: Styron Deutschland GmbH (0.0%, i.e. exemption from the measure), Versalis UK Ltd. (0.0%, i.e. exemption from the measure), Versalis S.p.A. (9.0%), Synthos Dwory 7 Sp. z.o.o S.J. (6.9%), Synthos Kralupy A.S. (6.9%), Dow Europe GmbH (20.8%), Manufacture Francaise Pneumatiques Michelin (20.8%), Ravago Production (20.8%) and S.P.A. Michelin Italiana (20.8%). This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on November 20th, 2015, and is applicable for a period of five years.

On November 19th, 2015, the Brazilian authorities decided to suspend for one year the anti-dumping measure imposed on imports of Emulsion Styrene-Butadiene Rubber (E-SBR) from the European Union (Resolution Camex No. 110, 19.11.2015). Reason for this decision is public interest and the necessity to preserve price stability.
This suspension entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on November 20th, 2015.
 
On 10 October 2016, the Brazilian authorities decided to extend the suspension period from 20 November 2016 for an additional year of the anti-dumping measure imposed on imports of Emulsion Styrene-Butadiene Rubber (E-SBR) from the European Union (Resolution Camex No. 96).

On 18 October 2017, the Brazilian authorities terminated the definitive duty imposed on imports Emulsion Styrene-Butadiene Rubber (E-SBR) from the European Union. Notably, the imposition of definitive duties has been suspended since 20 November 2015.
