Anti-dumping

On March 31, 2008, the Indian authorities initiated a sunset review of the anti-dumping duty imposed on imports of measuring tapes (all types of steel measuring and fibre glass tapes and their parts or components) from China.
The products subject to investigation are classified under the following HS codes: 9017.80 and 9017.90.
This review follows the application lodged by M/s FMI Limited, Ludhiana and M/s. Freemans Measures Pvt Ltd., Ludhiana.
 
On March 27, 2009, the Indian authorities issued their final findings of the sunset review. They recommended the continuation of the existing anti-dumping measure.
 
On May 15, 2009, the Indian authorities issued the notification of extension of the anti-dumping duty imposed on imports of measuring tapes from China classified under HS codes 9017.8010, 9017.9000 and 8486.9000 (Notification No. 49/2009-Customs, 15.05.2009). The amount of the duty imposed on steel tapes and their parts and components is USD 4.19 per kilogram. The amount of the duty imposed on fibre glass tapes and their parts and components is USD 4.10 per kilogram.
This duty is effective for a period of five years.
 
The original anti-dumping duty was decided on September 1, 2003 and imposed by Notification No. 147/2003-Customs on October 7, 2003.
 
On May 9, 2014, the Indian authorities initiated a second sunset review of the anti-dumping duty imposed on imports of measuring tapes from China.
This review follows the application lodged by M/s FMI Limited, Ludhiana, a major domestic producer of measuring tapes.
 
While initiating the sunset review, the Indian authorities decided on July 4th, 2014 to extend up to May 14th, 2015 the existing definitive anti-dumping duty imposed on May 15th, 2009 by Notification No. 49/2009-Customs (Notification No. 29/2014-Customs (ADD), 04.07.2014).
 
On May 5th, 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, issued its final findings of the sunset review. It recommended the continuation of the existing anti-dumping measure.
 
On July 9th, 2015, the Indian Ministry of Finance issued the Customs Notification of extension of the anti-dumping duty imposed on imports of steel and fibre glass measuring tapes originating in China (Notification No. 31/2015-Customs (ADD), 09.07.2015). HS code 8486.9000 is no longer mentioned; hence goods subject to the measure are only classified under HS codes 9017.8010 and 9017.9000.
The amount of the duty imposed on steel tapes and their parts and components is USD 2.83 per kilogram. The amount of the duty imposed on fibre glass tapes and their parts and components is USD 1.33 per kilogram.
This duty is effective for a period of five years.
