On February 11, 2011, the Indian authorities initiated a sunset review of the anti-dumping duty imposed on imports of partially oriented yarn (the yarn of polyester and an intermediate, which is subject to further processing, for example, texturising or draw twisting, to make it suitable for weaving or knitting into fabrics) from China.
The product subject to investigation is classified under the following HS code: 5402.4200.
On February 10, 2012, the Indian authorities issued their final findings of the sunset review. They recommended the continuation of the existing anti-dumping measure.
On May 2, 2012, the Indian authorities issued the notification of extension of the anti-dumping duty imposed on imports of partially oriented yarn from China (Notification No. 22/2012-Customs (ADD), 02.05.2012). The anti-dumping duty is imposed on products classified under heading HS code 5402. The amount of the duty is USD 545.22 per metric tonne. This duty is effective for a period of five years.
The original anti-dumping duty was decided on June 8, 2007 and imposed by Notification No. 92/2007-Customs on August 3, 2007. The amount of this duty was already USD 545.22 per metric tonne.
On 28 April 2017, the Indian Directorate General of Antidumping & Allied Duties, Ministry of Commerce and Industry initiated a sunset review of the antidumping duty imposed on the subject good from China. This follows the application lodged by Reliance Industries Limited supported by Indo Rama Synthetics (India) Ltd, JBF Industries Limited, Garden Silk Mills Ltd, and Alok Industries Limited.
On 9 May 2017, in connection with the above sunset review the Indian Ministry of Finance issued the Customs Notification extending the definitive antidumping duty on imports of the subject good from China for one year i.e. until 1 May 2018.
