Safeguard

On 15 April 2009, the Ministry of Industry and Trade of the Russian Federation issued a decision to impose safeguard duty on cutlery (1.4 US dollars per kilo). The products subject to safeguard duties fall under the following HS code subheadings: 8211 91 300 0, 8215 20 100 0 and 8215 99 100 0. The Ministry offered to exclude Belarus and other developing countries enjoying the Russia's system of trade preference (but to include China). The duty will remain in place for 3 years from August 26, 2009.

On 22 June 2011, the Customs Union Commission issued Decree 704 replacing and thereby terminating the above safeguard duty, see related state act. The decree came into force on 21 August 2011. According to article 4 of the "Agreement on the application of safeguard, antidumping and countervailing measures in transitional period" of 19 November 2010 when a trade defence measure imposed in the Customs Union enters into force the corresponding national measure is terminated. As safeguard measure was extended to the Customs Union the above safeguard duty was terminated on 21 August 2011.
