Anti-dumping

On July 8, 2008, the Indian authorities initiated an anti-dumping investigation on imports of plastic processing machinery (all kinds of plastic processing or injection moulding machines, also known as injection presses, having clamping force not less than 40 tonnes, used for processing or moulding of plastic materials) from China.
The products subject to investigation are classified under the following HS code: 8477.1000.

On February 10, 2009, the Indian authorities issued their preliminary findings and recommended the imposition of a provisional anti-dumping duty. This provisional duty was imposed on May 12, 2009 (Notification No. 47/2009-Customs, 12.05.2009). The rate of the duty ranges from 76% to 223% of the CIF value, depending on the Chinese producer.

On July 6, 2009, the Indian authorities extended the time for completion of the investigation by six months, i.e. up to January 7, 2010.

On December 31, 2009, the Indian authorities issued their final findings and recommended the imposition of a definitive anti-dumping duty. This definitive duty was imposed on March 23, 2010 (Notification No. 39/2010-Customs, 23.03.2010). The rate of the duty ranges from 60% to 174% of the CIF value, depending on the Chinese producer. This definitive duty is effective for a period of five years with effect from the date of imposition of the provisional anti-dumping duty, i.e. from May 12, 2009.

On May 9, 2014, the Indian authorities initiated a sunset review of the above-mentioned anti-dumping duty imposed on imports of plastic processing machinery from China.

On June 19, 2014, the Indian authorities issued the notification of provisional extension of the anti-dumping duty imposed by Notification No. 39/2010-Customs dated March 23, 2010 (Notification No. 28/2014-Customs (ADD), 19.06.2014). This duty remains into force upto and inclusive of May 11, 2015.

On June 2nd, 2015, the Indian authorities extended the time for completing the sunset review up to August 8th, 2015.

On August 18th, 2015, the Indian authorities extended again the time for completing the sunset review up to November 8th, 2015.
 
On 8 October 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of plastic processing machinery (all kinds of plastic processing or injection moulding machines, having clamping force between 40 and 1000 tonnes, used for processing or moulding of plastic materials) originating in or exported from China.
On 4 December 2015, the Indian Ministry of Finance issued the Customs Notification imposing this definitive anti-dumping duty (Notification No. 57/2015-Customs (ADD), 04.12.2015). The amount of the duty imposed on imports originating in or exported from China is 29% of the landed value. This definitive duty is effective for a period of five years.
