Anti-dumping

On September 7, 2012, the Indian authorities initiated a sunset review of the anti-dumping duty imposed on imports of ductile iron pipes from China. The products subject to investigation are classified under the following HS codes: 7303.0030 and 7303.0090.

On September 4, 2013, the Indian authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of ductile iron pipes from China. The amount of the duty is USD 139.79 per metric ton, at the exception of the company Xinxing Ductile Iron Pipes Co. Ltd. whose exports are subject to a duty of USD 127.40 per metric ton. This duty entered into force on October 10, 2013.

On 9 October 2018, the Indian authorities initiated a sunset review of the definitive antidumping duty imposed on imports of the subject good from China. This follows the application lodged by Electrosteel Casting Limited and Srikalahasti Pipes Limited (SPL) and M/s Jindal Saw Limited. On the same day, in connection with the aforementioned sunset review, the Indian Ministry of Finance issued the Customs Notification extending the definitive antidumping duty on imports of the subject good from China until  9 April 2019.

On 10 April 2019 the Indian Ministry of Finance issued Notification No. 18/2019-Customs (ADD) extending the definitive antidumping duty on imports of the ductile iron pipes from China until 9 May 2019. The duty was extended pursuant to the judgement issued by Hon’ble High Court of Gujarat based on the Special Civil Application No. 6896 of 2019.

On 9 May 2019, the Indian Ministry of Finance issued Notification No. 21/2019-Customs (ADD) extending the definitive antidumping duty on imports of the subject good from China until 23 June 2019. The duty was extended pursuant to a second judgement issued by Hon’ble High Court of Gujarat based on the Special Civil Application No. 6896 of 2019.

On 23 June 2019, the Indian Ministry of Finance issued Notification No. 25/2019-Customs (ADD) extending the definitive antidumping duty on imports of the subject good from China until 9 October 2019. The duty was extended pursuant to a third judgement issued by Hon’ble High Court of Gujarat based on the Special Civil Application No. 6896 of 2019.

On 28 September 2019, the Indian Ministry of Finance issued Notification No. 39/2019-Customs (ADD) rescinding Notification No. 23/2013-Customs (ADD) thereby terminating the definitive duty imposed on imports of ductile iron pipes from China. This follows the Hon’ble High Court of Gujarat setting aside its third judgement concerning the extension of definitive duties until 9 October 2019.
