NoOn September 5, 2013, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, initiated an anti-dumping investigation on imports of electrical insulators of glass, or eramics/porcelain, whether assembled or unassembled, from China. The following items are excluded from the product scope of this investigation: telephone or telegraph insulators of voltage rating up to 1 kV, electrical or electronic appliances/device insulators of voltage rating up to 1 kV, and composite insulators. The products subject to investigation are classified under the following HS sub-heading: 8546.10 and 8546.20. This follows the application lodged by WS Industries (India) Ltd., Modern Insulators Limited, Insulators and Electrical Company, Bharat Heavy Electrical Limited and Aditya Birla Nuvo Ltd., companies that represent significantly more than 50% of the domestic production of the subject goods.
On July 1, 2014, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, issued its preliminary findings and recommended the imposition of a provisional anti-dumping duty on imports of electrical insulators from China.
On September 16, 2014, the Indian Ministry of Finance issued the Customs Notification imposing a provisional anti-dumping duty on imports of electrical insulators originating in China (Notification No. 40/2014-Customs (ADD), 16.09.2014). The amount of the duty ranges from USD 287 to USD 2,042 per metric ton, depending on the Chinese company. This duty shall remain into force for a period of six months.
On March 4, 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of electrical insulators originating in China.
On April 11, 2015, the Indian Ministry of Finance issued the Customs Notification imposing this definitive anti-dumping duty (Notification No. 11/2015-Customs (ADD), 11.04.2015). The amount of the duty ranges from USD 128 to USD 2,042 per metric ton, depending on the Chinese company.
This definitive duty is effective for a period of five years with effect from the date of imposition of the provisional anti-dumping duty, i.e. from September 16, 2014.
On 10 January 2019, the Indian authorities initiated a sunset review of the definitive duty imposed on imports of electrical insulators from China. This follows the application lodged by Aditya Birla Insulators, Insulators and Electricals Company and Modern Insulators Ltd.
On 14 September 2019, the Indian Department of Revenue of the Ministry of Finance issued Notification No. 37/2019-Customs (ADD) extending the definitive duty following the conclusion of the sunset review. The rate of duty is USD 638 or 1,383 per tonne depending on the company. The duty is in force for a period of five years.
