Anti-dumping

On June 5, 2013, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, initiated an anti-dumping investigation on imports of sodium nitrate from China, the European Union, South Korea and Ukraine.
The product subject to investigation is classified under the following HS code: 3102.5000.
According to the UN Comtrade Database, in 2012 no EU member states exported goods classified under HS code 3102.50 to India with a trade value over the GTA threshold of USD 1 million. Bulgaria exported goods classified under HS code 3102.50 to India for USD 333,636; Germany for USD 87,289.
On January 6, 2014, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its preliminary findings and recommended the imposition of a provisional anti-dumping duty on imports of sodium nitrate originating in China, the European Union, South Korea and Ukraine.
On March 19, 2014, the Indian Ministry of Finance issued the Customs Notification imposing this provisional anti-dumping duty (Notification No. 14/2014-Customs (ADD), 19.03.2014). The HS code affected by the duty is not only 3102.5000 but the subheading 2834 as well (specifically 2834.10, 2834.21, 2834.29. The amount of the duty imposed on imports originating in China is USD 0.15 per kilogram. The amount of the duty imposed on imports originating in the European Union is USD 0.19 per kilogram. The amount of the duty imposed on imports originating in Ukraine is USD 0.17 per kilogram. The amount of the duty imposed on imports originating in South Korea is USD 0.13 per kilogram. This provisional duty is effective for a period of six months.
On August 1, 2014, the Indian authorities extended the time for completing the investigation up to December 4, 2014.
On November 12, 2014, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of sodium nitrate originating in China, the European Union, South Korea and Ukraine.
According to the UN Comtrade Database, in 2013 the following EU member state exported goods classified under HS codes 3102.50 and 2834 to India with a trade value over the GTA threshold of USD 1 million: Germany (the major part of the exports being labelled under the broader subheading 2834 and might not all be exports of sodium nitrate).
On February 10, 2015, the Indian Ministry of Finance issued the Customs Notification imposing this definitive anti-dumping duty (Notification No. 03/2015-Customs (ADD), 10.02.2015). The HS code affected by the duty is not only 3102.5000 but the subheading 2834 as well. The amount of the duty imposed on imports originating in China is USD 137.35 per metric ton. The amount of the duty imposed on imports originating in the European Union is USD 171.79 per metric ton. The amount of the duty imposed on imports originating in Ukraine is USD 157.91 per metric ton. The amount of the duty imposed on imports originating in South Korea is USD 117.20 per metric ton. This definitive duty is effective for a period of five years from the date of imposition of the provisional anti-dumping duty, that is March 19, 2014.
