On January 29, 2009, the Argentinian authorities decided, after having conducted a review, to continue the anti-dumping duty on imports of certain helical drills with cylindrical tip from China (Resolution 32/2009, 29.01.2009).
The products subject to the duty are classified under the following HS codes: 8207.5011 and 8207.5019.
A minimum FOB export value has been set by the Argentinian authorities for each good depending on its technical characteristics. For details, see Annex of Resolution 32/2009. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on January 30, 2009, and is applicable for a period of five years.
This duty follows a review requested by Ezeta Financiera Inmobiliaria, Comercial e Industrial S.A. A review was then initiated by the Argentinian Ministry of Economy and Production on August 2, 2007 (Resolution 26/2007, 02.08.2007). Resolution 26/2007 was published in the Official Journal of the Argentinian Republic on August 6, 2007.
The original anti-dumping duty on helical drills with cylindrical tip was decided on August 11, 2000 (Resolution 677/2000, 11.08.2000). It was then already extended on August 4, 2004 following a review (Resolution 508/2004, 04.08.2004).
On January 28, 2014, the Argentinian authorities decided to open a sunset review of the anti-dumping duty imposed by Resolution 32/2009 dated January 29, 2009 (Resolution 16/2014, 28.01.2014). The review was requested by Ezeta Financiera Inmobiliaria, Comercial e Industrial S.A. Resolution 16/2014 was published in the Official Journal of the Argentinian Republic on February 14, 2014.
On January 27, 2015, the Argentinian authorities terminated the review and imposed minimum FOB export prices for each good depending on its technical characteristics (Resolution 21/2015, 27.01.2015). This anti-dumping measure entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on January 28, 2015, and is applicable for a period of five years.
On 27 January 2020, the Argentinian authorities initiated a sunset review of the definitive duty imposed on the subject good from China. This follows the application lodged by EZETA FINANCIERA INMOBILIARIA, COMERCIAL E INDUSTRIAL SOCIEDAD ANÓNIMA. The definitive duty will remain in force for the duration of the investigation.
On 23 July 2021, the Argentinian authorities issued a resolution extending the definitive duty imposed on imports of certain helical drills with cylindrical tip from China following the conclusion of the sunset review. The duty under Resolution 21/2015 (27 January 2015) will be maintained. The definitive anti-dumping duty will be equivalent to the difference between a set minimum FOB export value and the declared FOB export price. The resolution extending the definitive duty entered into force on 23 July 2021.
