Anti-dumping

On May 24 2010, the Peruvian authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of poplin shirting fabrics (unbleached, bleached or dyed plain weave fabrics), less than 1.80 meter wide, weighing between 90 and 200 g/m2, of polyester-cotton blend (wherein polyester predominates in weight) from China (Resolution No. 105-2010/CFD-INDECOPI, 24.05.2010).
The products subject to the duty are classified under the following HS codes: 5407.8100, 5407.8200, 5512.1100, 5512.1900, 5513.1100, 5513.2100, 5514.1100 and 5514.2100. The amount of the duty is USD 1.29 per kilogram.
This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on May 31, 2010. This duty follows an expiry review requested on February 20, 2009 by Consorcio La Parcela S.A. A review was then initiated by the Peruvian National Institute of Antitrust and Intellectual Property Protection (Indecopi) on May 11, 2009 (Resolution No. 078-2009/CFD-INDECOPI, 11.05.2009). The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on May 20, 2009.
The original anti-dumping duty imposed on certain types of poplin fabrics of polyester-cotton blend (wherein polyester predominates in weight) from China was decided on April 16, 2004 (Resolution No. 0124-2004/TDC-INDECOPI, 16.04.2004). This resolution was published in the Official Journal El Peruano on May 21, 2004.
On August 8, 2014, the Peruvian authorities decided to initiate a sunset review of the anti-dumping duty imposed on May 24, 2010 by Resolution No. 105-2010/CFD-INDECOPI (Resolution No. 086-2014/CFD-INDECOPI, 08.08.2014). This follows the request lodged on April 4, 2014 by Consorcio La Parcela S.A. The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on August 23, 2014. The existing anti-dumping duty remains in force during the review.
On November 14, 2014, the Peruvian authorities decided to initiate an ex officio review to determine, according to the current circumstances, whether or not to maintain (and, if maintained, whether or not to modify) the anti-dumping duty imposed on May 24, 2010 by Resolution No. 105-2010/CFD-INDECOPI (Resolution No. 131-2014/CFD-INDECOPI, 14.11.2014). The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on November 28, 2014.

On 19 February 2016, the Peruvian authorities decided to extend the above definitive duty for a period of 18 months (Resolution No. 021-2016 / CDB-INDECOPI, 23.02.2016). The resolution entered into force the day following its publication in the Official Journal El Peruano, i.e. on 24 February 2016.
 
On 28 May 2016, the Peruvian authorities amended the above anti-dumping duties from USD 1.19 per kilogram to USD 1.09 per kilogram (Resolution No. 087-2016 / CDB-INDECOPI, 28.05.2016).

On 24 August 2017, the Peruvian authorities terminated the definitive duty on imports of the subject good from China.
