Anti-dumping

On November 21, 2011, the Peruvian authorities decided, after having conducted a review, to continue the anti-dumping duty on imports of footwear (excluding sandals and flip flops) with uppers of any material excluding textile from China (Resolution No. 161-2011/CFD-INDECOPI, 21.11.2011).

The products subject to the duty are classified under the following HS codes: 6402.1900, 6402.2000, 6402.9100, 6402.9900, 6402.9990, 6403.9100, 6403.9190, 6405.1000, 6403.9900, 6403.9990 and 6405.9000. The amount of the duty depends on the HS classification of the good and on the declared FOB price. For details, see Annex of Resolution No. 161-2011/CFD-INDECOPI. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on November 30, 2011.

This duty follows an ex officio review, to determine whether or not to maintain the existing duty, decided on October 5, 2010 by the Peruvian Supervisory Commission on Dumping and Subsidies of the Indecopi itself (Resolution No. 176-2010/CFD-INDECOPI, 05.10.2010). The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on October 14, 2010.

The original anti-dumping duty imposed on certain footwear from China was decided on March 7, 1997 (Resolution No. 05-97-INDECOPI/CDS, 07.03.1997) and entered into force on the day of the second publication of the resolution in the Official Journal El Peruano, i.e. on March 16, 1997. It was then modified on January 21, 2000 by Resolution No. 001-2000/CDS-INDECOPI . Those modifications entered into force on the day of the second publication of the resolution in the Official Journal El Peruano, i.e. on January 31, 2000.
 
On 28 November 2016, the Peruvian authorities initiated a sunset review of the anti-dumping measure imposed on the subject good from China.

On 25 October 2017, the Peruvian authorities extended the definitive duty on the subject good from China following the conclusion of the sunset review. The amount of duty depends on the HS classification of the good and on the declared FOB price. The duty is imposed in USD per pair of shoes. For details, see Annex of Resolution No. 209-2017 / CDB-INDECOPI. The duty is in force for a period of five years from 30 October 2016.
